Oklahoma: Tort Reform Bills Pass Legislature, Sent to Governor

The Oklahoma state Legislature passed two bills last week dealing with tort reform. The first bill, SB 862, repeals the rule that awards in tort actions are “joint and several.” The joint and several rule states that each liable defendant is responsible for the entire judgment. It can lead to unfair situations where a defendant whose fault in a case is insignificant is nonetheless required to pay the entire judgment.
